General

These terms and conditions will be governed by and construed in accordance with the applicable laws of the United Kingdom (in respect of users residing in the United Kingdom) and the applicable laws of the Republic of Ireland (in respect of users residing in the Republic of Ireland) without regard to conflict of law principles, and you agree that all legal proceedings relating to the matters herein shall be adjudicated solely in the courts of either the United Kingdom or, where relevant, the Republic of Ireland. You consent to extra-territorial service of process and submit to the jurisdiction of the said courts.

If any portion of these terms and conditions is found to be illegal or unenforceable, it shall be deemed to be severable from and shall not affect the remaining provisions.

Any waiver of any provisions contained in these terms and conditions by PCL shall not be deemed to be a waiver of that right or any other right, term or provision of these terms and conditions.

If you have entered into a credit agreement with us you will also be governed by the terms of that agreement. The credit agreement will only come into effect and be binding when you sign it; until then no binding contract will be created.

Before you sign, please read the credit agreement carefully. If you discover that any of the information in the credit agreement is incorrect, please select edit and then correct your details. If you encounter any issues with this process then please return to the main menu and use the details in Contact Us to let us know so that we may send you a new credit agreement with the correct information.

You irrevocably confirm that in signing the credit agreement electronically and by accessing FCA Online you are the Borrower or you represent the Borrower and are acting with the authority of the Borrower to enter into the loan. Furthermore, you are the person named on the bank account and have the authority to set up Direct Debit Instructions or are acting with the authority and knowledge of the account holder.

We will always contact you using the most recent address and contact details you have provided for correspondence. All accounts must be registered with a valid personal email address that you access regularly so that the documents you have agreed to receive electronically can be sent to you. In addition, you must advise us of a change to your personal information including but not limited to your name, address, email address and bank details. We will not be liable for any loss or damage if you have not told us of a change and we fail to contact you or we send information to your former contact details.
